Yet another step has been made towards the entry into operation of the Unified Patent Court, with today’s rejection by the German Federal Constitutional Court (FCC) of the two applications for preliminary injunction against the ratification Bill of the Agreement on a Unified Patent Court.
The head of the Secretariat of the Preparatory Committee, Mrs Eileen Tottle, has moved on to other projects as from the 1st of July 2021. The Preparatory Committee thanks Eileen for her excellent services and wishes her all the best for the future!
The goal of bringing the Unified Patent Court into operation moves an important step closer this evening with the news from Germany that the Bundestag has voted on and approved the legislation for the Agreement on the Unified Patent Court and its Protocol on the provisional application.

With all things connected to setting up a new organization there are those hurdles you foresee and then there are those that you do not. The latter presents the greatest challenges and call for the greatest patience and resilience.
Following the major recruitment campaign in 2016 for judicial positions (both legal and technical) of the UPC, the Preparatory Committee has agreed to re-open recruitment for judicial positions to new applications.
2018 has been a year of mixed highs and lows. This year has seen two more Signatory States ratify the Unified Patent Court Agreement, namely Latvia and the UK which means there are now 16 ratifications in total of the Agreement, well over the number required.
