FEDERAL CONSTITUTIONAL COURT - Decision
With all things connected to setting up a new organization there are those hurdles you foresee and then there are those that you do not. The latter presents the greatest challenges and call for the greatest patience and resilience.
Following the major recruitment campaign in 2016 for judicial positions (both legal and technical) of the UPC, the Preparatory Committee has agreed to re-open recruitment for judicial positions to new applications.
2018 has been a year of mixed highs and lows. This year has seen two more Signatory States ratify the Unified Patent Court Agreement, namely Latvia and the UK which means there are now 16 ratifications in total of the Agreement, well over the number required.
This year has begun well for the project with Latvia ratifying in January and the UK ratifying the UPCA on 26 April. In addition, there are a number of contracting states who have ratified the Protocol on Privileges and Immunities over the last few months.
Yet another year of preparation has come to an end and it is time to sum up 2017 and plan ahead for 2018.
A case is currently pending in the German Federal Constitutional Court (FCC) concerning the law passed by the German Parliament on the implementation of the Agreement on the Unified Patent Court (UPCA).
The UPC case management system is the lifeblood of the court’s structure and its efficiency and reliability will be a key success factor.
