1. A confidentiality request is not too broad when asking that any information obtained on a non-confidential basis should still be protected if it originated from a source that is itself bound by a confidentiality agreement with the disclosing party or its affiliates. 2. The burden imposed on the other party, to verify that a disclosing third party is not bound by a confidentiality agreement itself, is not an undue one.

Ein Vertraulichkeitsantrag ist nicht zu weit gefasst, wenn er verlangt, dass Informationen, die auf nicht vertraulicher Basis erlangt wurden, auch dann geschützt werden sollten, wenn sie aus einer Quelle stammen, die ihrerseits an eine Vertraulichkeitsvereinbarung mit der offenlegenden Partei oder ihren verbundenen Unternehmen gebunden ist. 2. Die Last, die der anderen Partei auferlegt wird, um zu überprüfen, dass ein offenlegender Dritter nicht selbst an eine Vertraulichkeitsvereinbarung gebunden ist, ist nicht unangemessen hoch.
