Application Order

1. Ist eine in der Verfahrensordnung vorgesehene oder vom Gericht gesetzte Frist versäumt worden, bleibt der Partei nur die Stellung eines Antrags auf Wiedereinsetzung nach R. 320 VerfO, die R. 9.3 VerfO vorgeht. 2. Der Sorgfaltsmaßstab nach R. 320.1 VerfO ist autonom auszulegen. Die gebotene Sorgfalt („all due care“/„toute la viglance nécessaire“) ist grundsätzlich gewahrt, wenn die Partei alle zumutbaren Vorsorgeanforderungen getroffen hat, um ihr die Einhaltung der Frist zu ermöglichen.

(1) If a time limit provided for in the Rules of Procedure or set by the court has been missed, the party may only file an application for restitutio in integrum pursuant to Rule 320 of the Rules of Procedure, which takes precedence over Rule 9.3 of the Rules of Procedure. 2. the standard of due diligence pursuant to R. 320.1 of the Rules of Procedure is to be interpreted autonomously. Due diligence (“all due care”/“toute la viglance nécessaire”) is generally met if the party has taken all reasonable precautions to enable it to meet the deadline.
