In preparation for the start of operations, thePatent Mediation and Arbitration Centre of the Unified Patent Court (PMAC) is actively engaging users in shaping its regulatory framework.

With swift progress underway, the PMAC is on track to become fully operational by early 2026, providing an efficient, specialised, and user-focused forum for alternative resolution of patent and related IP disputes. As a cornerstone of the UPC’s mission, the Centre reinforces Europe’s commitment to balanced, effective, and innovation-friendly patent litigation.

On 21 May 2025, the PMAC opened the public consultation to invite valuable input from a broad spectrum of stakeholders worldwide. This is a crucial step in shaping the PMAC’s legal and procedural framework to meet the evolving needs of the global IP community. It also marks the beginning of ongoing public engagement, with further regulatory elements, such as the draft Arbitration Rules, set to be shared for consultation soon.

The draft Mediation Rules offer a modern, flexible, and user-friendly approach tailored specifically for IP disputes. Highlights include the option for fully online proceedings, adaptable processes designed to fit each case’s unique circumstances, and special provisions for disputes involving Standard Essential Patents (SEPs) and FRAND licensing terms. These rules aim to ensure dispute resolution is efficient, confidential, cost-effective, and accessible to all.

The public consultation will remain open until 21 July 2025. Stakeholders are encouraged to review the draft rules and share their feedback via email at contact-pmac@unifiedpatentcourt.org.
