Application Order

1. Artikel 69(4) EPGÜ sieht keine Verpflichtung der Beklagten zur Leistung einer Sicherheit vor. 2. Der Kläger kann vom Beklagten die Leistung einer Sicherheit für die Kosten verlangen, soweit es sich um die Widerklage auf Widerruf handelt, da ein Beklagter, der als Widerkläger auftritt, in den Anwendungsbereich von Art. 69(4) EPGÜ fällt.

Art. 69(4) UPCA; R. 158 RoP; Security for costs

1. Article 69(4) UPCA does not provide for an obligation on the part of the Defendant to provide security. 2. A Claimant can request a Defendant to provide security for costs to the extent that it concerns the counterclaim for revocation as a Defendant acting as Counterclaimant falls within the scope of Art. 69(4) UPCA.
